1. Acceptance of Terms

By accessing or using the ADU Builder Match website, submitting any form, claiming or managing a business listing, or otherwise interacting with any service offered by ADU Builder Match ("we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all other policies incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Site and all associated services.

We reserve the right to modify these Terms at any time. Continued use of the Site after any modification constitutes acceptance of the revised Terms.

2. Description of Service

ADU Builder Match operates an online directory, comparison resource, and homeowner-matching platform focused on accessory dwelling unit (ADU) construction and related services. The Site may provide directory listings of ADU builders and professionals, homeowner project submission and lead-matching services, ADU cost guides and permit guides, cost calculators and planning tools, listing claim and management services for businesses, and sponsored or featured listing placements.

3. ADU Builder Match Is Not a Contractor, Advisor, or Guarantor

This section is critical. Please read it carefully.

ADU Builder Match is an informational directory and lead-matching platform only. We are not a licensed contractor or builder, architect or engineer, permit consultant, real estate broker, financial advisor, insurance provider, legal advisor, or construction manager of any kind.

ADU Builder Match does not perform, supervise, oversee, or take any responsibility for construction work, architectural or engineering services, permit applications or approvals, financing, insurance, real estate transactions, or any professional services of any kind.

Listings on this Site — including Featured, Verified, Sponsored, or Claimed listings — are informational and do not constitute our endorsement, certification, guarantee, or recommendation of any business or their services, unless explicitly stated.

4. No Guarantee of Results

ADU Builder Match makes no guarantees, representations, or warranties of any kind regarding outcomes or results. Without limiting the foregoing, we do not guarantee that a homeowner will be matched with or contacted by a builder; the accuracy, completeness, or currency of any listing, cost estimate, or permit guide; that any listed builder is licensed, insured, bonded, or in good standing; any specific project pricing, timeline, or total project cost; permit approval or processing timelines; or the continued operation of the Site or any feature.

5. Homeowner Responsibilities

Homeowners who use ADU Builder Match are solely responsible for independently verifying contractor license status with the California Contractors State License Board (CSLB), confirming current liability and workers' compensation insurance, reviewing references and past project history, independently verifying all permits required for their specific project and jurisdiction, obtaining and reviewing all written contracts before signing, and consulting licensed architects, permit consultants, financial advisors, attorneys, and other qualified professionals before making decisions about their ADU project.

ADU Builder Match is not responsible for any outcome of a homeowner's decision to work with or not work with any professional identified through our platform.

6. Listing Types and Disclaimer

Directory Listing: Created from publicly available information. May not have been reviewed or submitted by the listed business.

Claimed Listing: A representative of the business has submitted a claim request. Does not constitute our approval, endorsement, or verification.

Verified Listing: Certain submitted information has been reviewed by ADU Builder Match. Verification is limited in scope and does not constitute a guarantee, endorsement, or warranty.

Sponsored Listing: The business has paid for enhanced placement or other commercial arrangements. Sponsored listings will be labeled where applicable.

Important Disclaimer: A listing of any kind — including a Verified or Claimed listing — is not an endorsement, guarantee, certification, recommendation, or warranty of any kind. You should independently verify all material facts about any professional before engaging their services.

7. Lead Matching and Contact Consent

7.1 Authorization to Share Your Information

By submitting a project request, you expressly authorize us to receive, review, and store your submitted information; contact you regarding your project submission; and share your contact information, property location, project details, budget, and timeline with selected ADU professionals so those professionals may evaluate and contact you about your ADU project. Consent to be contacted is not a condition of any purchase.

7.2 TCPA Disclosure

By providing your phone number and submitting a project request, you consent to be contacted by ADU Builder Match and by matched ADU professionals regarding your ADU project, which may include calls, text messages, or prerecorded messages to the phone number you provided, even if that number is on a state or national Do Not Call list. Standard message and data rates may apply. You may revoke this consent at any time by contacting us at privacy@adubuildermatch.com.

7.3 Limitation of Liability for Builder Contact

ADU Builder Match is not responsible for the frequency, content, timing, or method of communications by matched ADU professionals once your information has been shared. Each ADU professional is independently responsible for complying with applicable laws. If you have a complaint about a specific professional's contact practices, please contact that professional directly and notify us at privacy@adubuildermatch.com.

8. Builder and Professional Responsibilities

ADU professionals who receive homeowner leads through ADU Builder Match agree to: use homeowner information only to respond to the specific submitted project request; not resell, redistribute, or transfer lead information to any third party; comply with all applicable federal, state, and local laws including the TCPA, CAN-SPAM Act, CCPA/CPRA, and California contractor licensing laws; maintain a current, valid contractor license in good standing; and honor homeowner opt-out and contact limitation requests promptly.

9. Listing Claim Rules

Submitting a claim request does not guarantee approval or immediate changes to the listing. ADU Builder Match may require verification before approving any claim, may reject or edit submitted content, and reserves the right to remove, modify, or delist any listing at any time, at our sole discretion.

10. User-Submitted Content

Users who submit content — including photos, descriptions, and profile updates — represent that they own or have all necessary rights to the content, the content is accurate and does not infringe any third-party rights, and the content does not contain unlawful or harmful material. By submitting content, you grant ADU Builder Match a non-exclusive, royalty-free, worldwide, perpetual license to display and use the content in connection with the operation and improvement of the Site.

11. No Professional Advice

All cost guides, permit guides, calculators, articles, and other content on ADU Builder Match are provided for general informational purposes only and do not constitute legal, financial, architectural, permitting, or construction advice. Cost estimates and regulatory summaries may be inaccurate or inapplicable to your specific property or jurisdiction. Always consult a qualified licensed professional before making decisions about your ADU project.

12. Payments, Sponsored Listings, and Lead Fees

ADU Builder Match may receive compensation from builders and partners for qualified homeowner project requests, sponsored listings, featured placement, and other commercial services. Compensation may affect the placement of certain listings where clearly labeled. Compensation does not affect the content of informational guides or editorial content.

13. Prohibited Uses

Submitting false, misleading, or fraudulent information in any form
Impersonating any person, business, or entity
Scraping, crawling, or systematically extracting data without written permission
Using automated tools, bots, or scripts to access or interact with the Site
Reselling, redistributing, or licensing lead information received through the platform
Using lead information for any purpose other than responding to the specific project request submitted
Interfering with the security, integrity, or performance of the Site
Using the Site in any manner that violates applicable law

14. Third-Party Websites and Services

ADU Builder Match does not own, control, monitor, or take responsibility for any third-party website, its content, privacy practices, or data collection activities. Accessing a third-party website through a link on our Site is entirely at your own risk.

15. Intellectual Property

All content on the ADU Builder Match Site is the property of ADU Builder Match or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or modify any content from the Site without our prior written permission, except for personal, non-commercial use.

16. Disclaimers

The site and all services, content, listings, resources, tools, and information provided by ADU Builder Match are provided on an "as is" and "as available" basis without warranties of any kind. To the maximum extent permitted by applicable law, ADU Builder Match expressly disclaims all warranties, express, implied, statutory, or otherwise.

17. Limitation of Liability

THIS SECTION SIGNIFICANTLY LIMITS OUR LIABILITY TO YOU. PLEASE READ IT CAREFULLY.

To the maximum extent permitted by applicable law, ADU Builder Match and its owners, officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including damages arising from the conduct of any ADU professional, homeowner-builder disputes, construction defects, errors in listings or guides, failure to be matched with a builder, or the contact practices of any matched professional — whether based on warranty, contract, tort, or any other legal theory.

In no event shall the total aggregate liability of ADU Builder Match to you for all claims exceed the greater of: (A) $100.00, or (B) the total amount you paid to ADU Builder Match in the twelve months preceding the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless ADU Builder Match and its owners, officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, liabilities, judgments, penalties, costs, and expenses — including reasonable attorneys' fees — arising out of or relating to your use of the Site, any information you submit, your violation of these Terms, your claim or management of any business listing, your receipt of homeowner lead information, any dispute arising from your conduct or services, any TCPA claim arising from calls or texts you sent in connection with a project lead, or any failure to obtain or maintain required licensing or insurance.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.

WAIVER OF CLASS ACTIONS AND JURY TRIAL: TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY AND NOT AS PART OF ANY CLASS OR REPRESENTATIVE ACTION. YOU HEREBY WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING FROM OR RELATED TO THESE TERMS.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of the remaining provisions.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and ADU Builder Match with respect to your use of the Site and services.

22. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date. Continued use of the Site after revised Terms have been posted constitutes your acceptance of the updated Terms.
